Honda just announced the the new 2009 Honda, maybe you should go the web site, build your vehicle, order it, take delivery, drive it for a while and then sue them because you just realized it the old 2008 model. A press release is just that, an announcement of something that is going to happen in the future. In August that is all about all the information that was available on the Sync system. I wanted to be an early adopter and I was very careful, to make sure that I understood what I was ordering, since the salesmen still hadn't heard more than rumors (that is about all a press release is anyways).
Because of my order, I watched the Ford web pages very closely. There was no mention of the Sync system on the Taurus X product page until the hold on Sync was lifted which happened in Late October or early November. Also it was a late decision to make Sync standard with the Limited, when I ordered mine it was actually a separate item with the price to be determined. Mine wasn't built until December 7th but did not delivered to the dealer until Jan 14th.
I am sorry you are disappointed, but unfortunately at the time, unless you knew the order code to get Sync to appear on your order, you would get a standard non Sync vehicle. Taking this to court is absurd, you are waisting my tax dollars and raising cost for manufacturers making my vehicle more expensive. If you want to be an early adopter, do your research, and double check your vehicle before you sign on the dotted line.
This article show the price was announced in early August, but would even be available until fall.

Here is the Ford order guide, it is a Ford internal document, but these things leak onto the internet almost immediately.
You can see that Sync is optional on the Limited at the time.
